Terms of Service

1. Agreement to Terms
By accessing or using the services provided by Watchtower Cybersecurity, a division of HeardChef86ix Inc. (“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all visitors, clients, and users of our website and professional services.
2. Services
Watchtower Cybersecurity provides website security audits, automated vulnerability assessments, SEO optimization, OSINT research, and continuous security monitoring. The specific scope, deliverables, and timeline for each engagement are defined in a separate statement of work or engagement agreement between the Company and the client.
4. Confidentiality
All findings, reports, and data collected during an engagement are treated as confidential. The Company will not disclose client information, vulnerabilities discovered, or report contents to any third party without the client’s written consent, except as required by law. Clients receive exclusive ownership of all deliverables produced during their engagement.
5. Client Responsibilities
- Provide accurate information about systems, networks, and scope
- Obtain and provide all necessary authorizations for testing
- Maintain backups of systems prior to any active testing
- Designate a point of contact available during active engagements
- Notify the Company of any changes to systems during testing windows
6. Limitation of Liability
Security testing inherently involves interaction with live systems. While the Company exercises professional care and follows industry-standard methodologies, the Company is not liable for any service interruptions, data loss, or system instability that may occur during authorized testing within the agreed scope.
The Company’s total liability for any claim arising from services shall not exceed the fees paid for the specific engagement giving rise to the claim. The Company is not liable for indirect, incidental, consequential, or punitive damages.
7. No Guarantee of Security
Security assessments provide a point-in-time evaluation. The Company does not guarantee that all vulnerabilities will be identified, nor that systems will be immune to future attacks following remediation. Cybersecurity is an ongoing process, and the threat landscape evolves continuously.
8. Intellectual Property
All proprietary tools, methodologies, and frameworks used by the Company remain the intellectual property of HeardChef86ix Inc. Clients receive a non-exclusive license to use deliverables for their internal security purposes. The Company retains the right to use anonymized, aggregated findings for research and service improvement.
9. Payment Terms
Payment terms are specified in each engagement agreement. Unless otherwise agreed, invoices are due within 30 days of issuance. The Company reserves the right to suspend services on accounts with outstanding balances exceeding 60 days.
10. Termination
Either party may terminate an engagement with written notice. In the event of early termination, the client is responsible for fees associated with work already performed. The Company will provide all completed deliverables up to the termination date.
11. Indemnification
You agree to indemnify and hold harmless Watchtower Cybersecurity, HeardChef86ix Inc., and their affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from your misuse of deliverables, your violation of these terms, or your failure to maintain adequate authorization for testing activities.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising from these terms or our services shall be resolved through binding arbitration, unless both parties agree to alternative resolution.
13. Changes to Terms
The Company reserves the right to modify these terms at any time. Changes take effect upon posting to this page. Continued use of our services following changes constitutes acceptance of the revised terms. Existing engagement agreements remain governed by the terms in effect at the time of execution.
